Use of RPS Mentoring Service

These terms and conditions set out your rights, obligations and restrictions for use of the Royal Pharmaceutical Society of Great Britain’s (“RPS”) mentoring service (the “RPS Mentoring Service”). Prior to participating in the RPS Mentoring Service, please read these terms and conditions carefully. If you do not agree with these please refrain from using the RPS Mentoring Service.

Submission of Personal Details

Information you provide: You will be asked to provide identifying information about yourself (‘personal data’) including your name and email address when you complete the mentoring registration form.

Purpose of personal data: You are asked to provide personal data so that we can check you are a member of RPS and so that we can provide your name and email address to other members who wish you engage with you as a mentor or mentee.

Lawful basis for data processing: We process your personal data on the basis that it is necessary to process your personal data for the purposes of delivering our mentoring service, which you have voluntarily signed up to participate in. Further we have a legitimate interest in ensuring that mentors and mentees are members of the Royal Pharmaceutical Society as the mentoring services is a member-only benefit.

How your personal data will be used: Your personal data will be used to verify your identity as a member of RPS and to present potential mentors/mentees with a list of potential mentors/mentees. You may be contacted directly by a potential mentor/mentee using the personal data you provide through our mentoring services.

How long do we keep your personal data: Your personal data will be kept on our mentoring database until you advise us that you wish to terminate the mentoring service and/or you terminate your RPS membership.

Your responsibilities: You represent and warrant that all registration information you submit is truthful and accurate and you will maintain the accuracy of such information (including your email address).

Your rights: You have rights to correct and access your information and to ask for it to be erased in certain circumstances.

Data Protection

Information about mentors and mentees submitted to the RPS Mentoring Service will be processed, stored and shared by RPS in accordance with the Data Protection Act 2018 and the General Data Protection Regulation EC/2016/679. This information constitutes personal information and will be used only for the purposes of administering the mentoring service, and not for any third party or commercial mailings.

Use of Mentoring Service

You may only use the RPS Mentoring Service for lawful purposes. You may not use it:

  • for purposes that would breach any applicable local, national or international law or regulation or in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect
  • to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam)
  • to knowingly transmit any data, send or upload any material that contains viruses or any other harmful programs; for infringements of copyrights, patents or trademarks; for inappropriate sexual conduct; for harassment of other users; or impersonation of any persons for gain or benefit.

You must not use any personal data about a mentor/mentee (including their email address) for any purpose not related to mentoring.

While the mentoring process will facilitate the professional development of both mentor and mentee, the RPS Mentoring Service should not be considered as a substitute for professional judgment. The final responsibility for judgments and decisions made by participants in the RPS Mentoring Service, and the actions that flow from them, lie with participants in this service. RPS therefore recommends that service users personally assess the professionalism, experience and credentials and references of the mentor and agree contractual terms before entering into any mentoring programme. They should also satisfy themselves that the mentor possesses the experience necessary to deliver against their requirements.

While RPS has made every effort to ensure that mentoring provided through this service is of high quality and relevant to applicants, it cannot guarantee the integrity, quality or accuracy of the advice or guidance provided by mentors.

Confidentiality

Pharmacists have a professional requirement for confidentiality in patient care and this should be extended to professional networking within the RPS Mentoring Service. The RPS Mentoring Service is a private network for mentors and mentees, and it is expected that the mentoring relationship will be an exclusive one-to-one relationship. Discussions between mentor and mentee and information received as a result of the RPS Mentoring Service should be kept confidential and not disclosed unless required by law.

Limitation of Liability

The information in the RPS Mentoring Service is provided without any guarantees, conditions or warranties as to its accuracy. To the extent permitted by law, we, other members of our group of companies and third parties connected to us hereby expressly exclude: all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity; and any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with the RPS Mentoring Service or in connection with the use, inability to use, or results of the use of it. This does not affect our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any other liability which cannot be excluded or limited under applicable law.

Amendments & Changes

RPS may revise these terms and conditions at any time.

Termination or Suspension of Use

RPS will determine, in its discretion, whether there has been a breach of these terms and conditions. When a breach has occurred, RPS may take such action as it deems appropriate, including but not limited to immediate, temporary or permanent withdrawal of your right to use the RPS Mentoring Service.

Governing Law

These terms and conditions and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.

The English courts will have exclusive jurisdiction over any claim arising from, or related to the RPS Mentoring Service.
